Welcome to the website of GreenKayak (referred to herein as “GreenKayak” “Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms & Conditions”), govern your access to and use of http://greenkayak.com/ including any content, information, services, resources, products, functionality and other services offered on or through us via these websites or links from such sites (all of which are collectively called the “Website”) whether as a guest or a registered user.
These terms and conditions outline the rules and regulations for the use of www.greenkayak.org’s Website and booking the GreenKayak. By accessing or by clicking to accept or agree to this website we assume you accept these terms and conditions in full. Do not continue to use www.greenkayak.org’s website if you do not accept all of the terms and conditions stated on this page. Terms & Conditions – MUST read & consent before paddling a GreenKayak
By completing a booking with GreenKayak, you confirm that you have read, understood, and agreed to the following terms and conditions in full. The person making the booking is responsible for ensuring that all participants in the booking are made aware of and consent to these terms before the tour begins. This consent may be obtained verbally. GreenKayak excludes any and all claims from both the person making the booking and any other participant.
Use at your own risk. The use of a GreenKayak is entirely at your own risk. GreenKayak provides kayaks free of charge and accepts no liability whatsoever for personal injury, death, loss of or damage to personal property, or any other loss or damage arising from the use of a GreenKayak, howsoever caused.
Pre-use inspection & life jacket. Before entering the water, you are responsible for inspecting the kayak for visible damage, including checking that the kayak is not taking on water or showing any signs of structural damage. By launching, you confirm the kayak was in satisfactory condition at the time of departure.
Life jackets are provided and must be worn at all times on the water. You must ensure that you and all participants are wearing a properly fitted and fastened life jacket before entering the water. If you are unable to locate a life jacket at your location, you may NOT enter the water or paddle under any circumstances. Paddling without a life jacket is strictly prohibited. The host and GreenKayak accept no liability for personal injury where a life jacket has not been worn or where a participant has chosen to paddle without one.
Personal belongings. GreenKayak accepts no liability for any personal items including but not limited to mobile phones, clothes, cameras, keys, wallets, or any other valuables — whether lost, damaged, or rendered unusable as a result of water exposure or capsize. You are paddling a kayak on open water and must expect to get wet. Improper handling can result in capsize and permanent loss of equipment. You are strongly encouraged not to bring valuables. If you choose to bring valuables, you do so entirely at your own risk. We recommend bringing a waterproof bag, which you must supply yourself.
Swimming ability. You confirm that you are able to swim and are capable of taking care of yourself in the event of a capsize.
Kayaking experience & self-sufficiency. GreenKayak does not provide kayaking instruction, introduction, or any form of onboarding. You are expected to be self-sufficient on the water. Previous kayaking experience is an advantage. If you feel uncertain or unsafe about your ability to paddle, we strongly recommend watching kayaking tutorials online before booking. If this does not give you sufficient confidence, we recommend that you do not book a GreenKayak but instead seek a guided kayaking tour with professional instruction. By completing a booking, you confirm that you feel adequately prepared and capable of operating a kayak independently.
Health & fitness. You confirm that you are in a sufficient physical and mental health condition to safely operate a kayak.
Minors. Participants under the age of 18 must have explicit consent from a parent or legal guardian before participating. By completing a booking that includes a minor, the person making the booking confirms that such consent has been obtained and accepts full responsibility for the safety and conduct of all minors included in the booking.
Alcohol & substances. You must not operate a GreenKayak under the influence of alcohol or any other substances that may impair your judgement or physical ability. Consumption of alcohol or such substances during the paddle is strictly prohibited.
Weather conditions & return location. GreenKayak must not be used in adverse weather conditions, including but not limited to strong winds, poor visibility, thunderstorms, or conditions that exceed the paddler’s ability. It is your responsibility to assess weather and water conditions before and during the paddle and to return to shore if conditions deteriorate.
If you return to shore at a location other than the host location, you are fully responsible for arranging and covering the cost of transportation of the kayak back to the host location. GreenKayak and the host accept no responsibility for the retrieval or transport of kayaks returned to alternative locations.
Return time. You must return the kayak by the agreed time. If your return is delayed for any reason, you must inform the GreenKayak host immediately. If you fail to return by the agreed time and a search and rescue operation is initiated, you are fully financially responsible for all associated costs.
Liability for equipment. You are fully liable for any loss of or damage to the GreenKayak and its equipment during the period of your booking. You agree to cover the full cost of repair or replacement, even if the damage or loss was caused by a third party or natural forces.
Wildlife. You must maintain a safe distance from wildlife at all times and avoid paddling near nests or habitats, particularly during breeding seasons.
Personal responsibility & insurance. You assume full personal financial responsibility for any injury, loss, or damage arising from your use of a GreenKayak. If you hold personal liability insurance covering kayaking activities, that insurance applies in the first instance. GreenKayak does not require proof of insurance but strongly recommends that participants ensure adequate personal coverage before participating.
Social media & content. You agree to collect trash during your paddle and agree to share your experience using #greenkayak on social media. By doing so, you grant GreenKayak the right to repost and share your content.
Entire agreement. These terms constitute the entire agreement between you and GreenKayak regarding the use of the kayak. No verbal representations by hosts or staff shall modify or override these terms.

The following terminology applies to these Terms and Conditions, Privacy Policy and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client.
All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of . Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
To ensure fair access and maximize our environmental impact, each participant is allowed to hold only one booking per day and a maximum of five (5) open (upcoming) bookings at any given time. Please only book time slots you are reasonably certain you can use, as unused bookings block availability for others who also want to paddle and help clean the environment.
GreenKayak operates on trust, and by following these guidelines, you help ensure that more people can participate in our shared mission. We reserve the right to cancel bookings or block users who do not respect these rules, in order to maintain fairness and availability for the whole community.
Severability. If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
